Welcome to Phase Group LLC(“Phase Group,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website at https://phasegroup.ai (the “Site”) and any services we provide, including AI voice agents, AI chat widgets, and related consulting and implementation services (collectively, the “Services”).

By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

1. Services Overview

Phase Group provides AI-powered automation solutions for businesses, including but not limited to:

  • AI voice agents that answer and qualify inbound phone calls
  • AI chat widgets that capture and route website leads
  • Intake assessments and automation strategy recommendations
  • Implementation, integration, and ongoing support

The specific scope, pricing, and deliverables for each engagement will be outlined in a separate proposal or statement of work agreed upon by both parties before work begins.

2. Intake Process

Submitting an intake form on our Site does not constitute a binding agreement or guarantee of service. After reviewing your submission, we will provide a tailored recommendation. If both parties agree to proceed, a separate agreement will be established outlining the scope, timeline, and cost.

3. AI Disclaimer

Our AI-powered tools, including voice agents and chat widgets, are designed to assist with lead capture, qualification, and routing. However:

  • AI-generated responses may contain errors, inaccuracies, or incomplete information
  • Pricing or scheduling information discussed via AI is an estimate only and subject to confirmation
  • AI tools are not a substitute for professional, legal, medical, or emergency advice
  • We continuously improve our systems but cannot guarantee 100% accuracy or uptime

4. Payment Terms

Payment terms, including amounts, schedules, and accepted methods, will be specified in the proposal or statement of work for each engagement. Unless otherwise agreed:

  • A deposit may be required before work begins
  • Invoices are due within 14 days of receipt unless stated otherwise
  • Late payments may result in suspension of services

5. Refund Policy

We stand behind our work. If we fail to deliver the agreed-upon scope within the agreed-upon timeline, you may be eligible for a full or partial refund at our discretion. Refund eligibility will be evaluated on a case-by-case basis. Refunds do not apply to third-party costs (e.g., API usage, hosting, or software subscriptions).

6. Intellectual Property

All content on the Site — including text, design, code, logos, graphics, and AI system architectures — is the property of Phase Group LLC or its licensors and is protected by intellectual property laws.

  • You may not copy, modify, distribute, or reverse-engineer any part of the Site or Services without our written consent
  • Custom work delivered to you (e.g., configured AI agents, integrations) becomes your property upon full payment, unless otherwise stated in the agreement
  • We reserve the right to use anonymized, non-identifiable project details for portfolio and marketing purposes

7. Acceptable Use

You agree not to:

  • Use the Site or Services for any unlawful or fraudulent purpose
  • Attempt to disrupt, hack, or interfere with the Site or its infrastructure
  • Misrepresent your identity or impersonate another person or business
  • Use our AI tools to generate harmful, misleading, or abusive content
  • Scrape, crawl, or automatically extract data from the Site without permission

8. Limitation of Liability

To the maximum extent permitted by law, Phase Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or Services, including but not limited to lost revenue, lost leads, or business interruption.

Our total liability for any claim arising from these Terms or the Services shall not exceed the total amount paid by you to Phase Group LLC in the 12 months preceding the claim.

9. Third-Party Services

Our Services may integrate with or rely on third-party platforms (e.g., Vapi, OpenAI, ServiceTitan, GoHighLevel, Zapier). We are not responsible for the availability, accuracy, or terms of those third-party services. Your use of third-party integrations is subject to their respective terms and privacy policies.

10. Termination

Either party may terminate an engagement in accordance with the terms of the applicable statement of work or proposal. We reserve the right to suspend or terminate your access to the Site at any time if you violate these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” at the top of this page. Your continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.
